Planning Occupancy Conditions
Project Description Preparation, submission and management through to final decision of full planning application to remove conditions placed upon previous planning approvals.
Issues Encountered: These types of conditions were normally imposed upon new development in the open countryside or in areas of special protection such as coastal or inland water areas where development is not normally permitted unless a site specific need was demonstrated. In many cases planning permissions are issued with conditions that can restrict either the use or occupancy of the building in question. Such conditions are primarily attached to the following types of development and remain in place until their removal is granted.
- Farm workers dwellings
- Managers dwellings
- Dwellings for holiday accommodation (e.g. where the use of the building is restricted to short term letting only)
Strategic Planning’s Involvement To date Strategic Planning have been highly successful in getting these types of conditions removed within relatively short time frames by being able to demonstrate that the original condition was either unreasonable, served no planning purpose, or that there has been a change in personal circumstances or planning policy that would permit its removal.
